More criminal charges against former Hampton Elementary teacher

A former Hampton Elementary School teacher faces new criminal charges related to an inappropriate relationship with a student.

Wednesday night, Carter County Sheriff Chris Mathes said Kelly Smith, 40, was arrested by investigators and charged with aggravated statutory rape.  Smith was booked into the Carter County Sheriff's Office Detention Center with a $20,000 bond.

"This is the second arrest of Smith by the CCSO within a week," Mathes said.  The first arrest happened last Friday when Smith was charged with solicitation of a minor and two counts of solicitation of a minor to observe sexual conduct.

"Very inappropriate text messages from Mr. Smith to a 13-year-old female," Mathes said last Friday.  Mathes said the text messages included nude photos of Smith.

Mathes said a second alleged victim who is 16-years-old came forward and claimed she had sexual intercourse with Smith in December 2012.

"The second victim was a former student of Mr. Smith at Hampton Elementary School," Mathes said.  "It is believed that he engaged in an ongoing relationship with the juvenile dating back to when the child was in 6th grade."  

"The investigation of Smith also led to the recovery of a stolen SKS assault rifle which was found to have been stolen out of Knoxville, TN," said Mathes.

A Hampton Elementary School teacher is arrested after police find inappropriate text messages on a 13-year-old student's phone.

Carter County Sheriff Chris Mathes says officers arrested 30-year-old Kelly Smith on Friday.  Sheriff Mathes says the parents of the 13-year-old victim notified the Sheriff's Department about a inappropriate situation between their daughter and Smith.  The situation involved text messages and Facebook. 

"There were very inappropriate text messages from Mr. Smith to the 13-year-old female. Very disturbing, including pictures of himself, nudity and revealing himself," said Sheriff Mathes.

Smith is charged with one count of solicitation of a minor and two counts of solicitation of a minor to observe sexual conduct.

Smith is also currently on unpaid suspension from the school system due to a DUI charge back in February.

Sheriff Mathes says the mother of the girl inspected her daughter's cell phone monthly and that is how the relationship was discovered.  He says he encourages all parents to monitor their children's cell phones and Facebook.  He says if the mother of this victim had not been doing that, there is no telling what might have happened.
