Madison and Rankin Counties' District Attorney Michael Guest announced today that Bobby Lee Allen was found Guilty of Armed Robbery, Accessory After the Fact to Murder, and Conspiracy to Commit Armed Robbery, following a two day trial on February 26, 2013. He was sentenced this week to serve forty (40) years in prison on Armed Robbery, twenty (20) years for Accessory After the Fact to Murder, and five years for Conspiracy to Commit Armed Robbery. All sentences are to be served concurrently with each other and he must serve every day of the forty (40) year sentence without the possibility of probation, parole or early release.
On April 30, 2012, at approximately 11:00 p.m., the Ridgeland Police Department received a 911 call about gun fire at the Ridgeland Ranch Apartment complex. When officers arrived, they discovered 61 year old Luis Ortiz, who was dead of an apparent gunshot wound to his face. The wallet of Mr. Ortiz was found lying on his chest. The investigation revealed that Mr. Ortiz was the manager of a local Mexican restaurant and had over $600.00 on him from the restaurant's night deposit when he left that evening to return to his home at the Ridgeland Ranch Apartments.
The Ridgeland Police Department quickly apprehended three suspects: Robert Carson, Bobby Allen, and Edward Clay. The investigation revealed the three suspects had spent the day at a home in the Westwick Apartments in West Jackson, smoking marijuana, drinking codeine, and alcohol. When they ran out of money, the three decided to find a victim to rob. They armed themselves and left Westwick Apartments and drove to County Line road, where they drove through apartment complexes looking for a victim to rob. At trial, it was revealed Bobby Allen was the driver, Edward Clay was the passenger, and Robert Carson was the shooter.
When they arrived at the Ridgeland Ranch Apartments at approximately 11:00 p.m., they backed into a parking space and waited for any victim to come by. When Mr. Ortiz drove past them and parked, Robert Carson and Edward Clay approached him. Robert Carson then produced a firearm and demanded his money. In the course of taking his money, Robert Carson shot Mr. Ortiz in the head at point blank range.
The gunman in the case, Robert Carson, went to trial and was convicted by a jury on March 6, 2013, of Capital Murder, Felon in Possession of a Firearm, and Conspiracy to Commit Armed Robbery. He was sentenced to Life in Prison without the possibility of parole. Edward Clay has pled Guilty to Armed Robbery and is scheduled to be sentenced in July.
At the time of his arrest on this charge Bobby Lee Allen was out on bond from Hinds County for two counts of Armed Robbery. He has since been convicted in Hinds County of two counts of armed robbery.
Guest stated, "Bobby Allen is a dangerous individual who at the time of this offense had been released on bond for an armed robbery in Hinds County. After a day of drinking and drug use, Allen's sole purpose in coming to Madison County that night was to commit another armed robbery. Allen's sentence, following his conviction by a jury, will ensure the public that his days of terrorizing the citizens of Madison and Hinds County has ended."
Guest added, "The victim, Mr. Ortiz, was in this country legally, working hard, providing for his family, and he did nothing to deserve this horrible crime that was committed against him."
Guest concluded, "I am proud of the great job done by the Ridgeland Police Department. Their hard work has resulted in juries returning verdicts of guilty against Allen and Carson. We hope that these convictions and sentences will serve to send a message that we will not tolerate violent criminals endangering our communities."
