Driver accused in deadly I-581 crash pleads no contest

ROANOKE, VA -

New pavement on I-581 seems to erase any visible signs of what happened there almost three months ago.

However, for many people living in and around Roanoke, the deadly crash on June 12th, is a day that's hard to forget.

It's especially memorable for the two families who lost a loved one.

Images of the crash were shown in a Roanoke court Friday.

The man at the center of this wreck, 34-year-old Timothy Wellons, plead 'no contest' to 4 charges.

The charges are one count of assault and battery, two counts of aggravated, involuntary manslaughter and driving under the influence.

Evidence revealed Wellons' blood alcohol level was .34 an hour after the crash.

A receipt and surveillance video from an ABC store in Vinton shows Wellons purchasing a 750ml of vodka around 10 a.m. the day of the crash. A bottle matching that same description was found in has car 3/4 of the way empty.

Some of the EMT's at the crash described Wellons as "significantly impaired."

The assault and battery charges stem from Wellons bending back the fingers of a nurse.

"They describe Mr. Wellons as being combative, abusive, and cursing, and telling them they didn't know what they were doing," Assistant Commonwealths' Attorney, Wanda DeWease says. "It took 3 other people to make him release his grasp on her."

We learned doctors had to give Wellons a sedative to calm him down.

DeWease also said one of the hospital employees planned to testify that Wellons said he had side-swiped a tractor-trail or and then he laughed. While, authorities say he appeared to be remorseful when he was told two people died.

2:00 PM update:
Timothy Wellons plead no contest to all charges today in court. He faces up to 42 years in prison. The charges are one count of assault and battery, two counts of statutory aggravated involuntary manslaughter and driving under the influence. Prosecutors originally charged Wellons with common law manslaughter, but they indicted him on a higher manslaughter charger where he could have 20 years in prison instead of 10 years.

The man accused of driving drunk and causing an accident that killed two truck drivers is in court today.

Timothy Wellons, 35, is expected take a plea agreement after police say he caused a crash in June on Interstate 581 in Roanoke.

Wellons is charged with two counts of aggravated involuntary manslaughter and one count of DUI.

Lab testing shows Wellons' blood-alcohol content was more than four times the legal limit for driving.

In a bond hearing, prosecutors said he was on his way to pick 7-year-old son up when he crashed.
