Onslow Co. judge approves injunction against sheriff's office

JACKSONVILLE, N.C. -

An Onslow County judge is allowing a sweepstakes operation to continue doing business.

The Onslow County Sheriff's Office sent a letter to the business, called Gift Surplus, saying that it was operating illegally.

Sheriff Ed Brown wrote in a letter that the sweepstakes machines are a violation of state law.

But earlier this month a superior court judge in Onslow County disagreed, saying that the sweepstakes machines are in fact, legal, because the computer kiosks require skill and dexterity to win, unlike games of chance like poker.

Folks in Onslow County agree with the injunction.

"If they're not actually legal, then of course they should be able to seize them, but with them being legal, it really shouldn't matter, they shouldn't be after them," said Rachael Simpson, an Onslow County visitor.

Gift Surplus is based out of state, but is licensed to do business in North Carolina.
