Jackson County Sheriff Mike Byrd says he will resign Dec. 31 but county leaders are questioning why Byrd is waiting so long.
Byrd presented his resignation letter to Board of Supervisor President Mike Mangum on Wednesday night. Mangum says supervisors will discuss Byrd's staying in office until the end of the year with the county legal team.
District Attorney Tony Lawrence says he's going to talk with the attorney general's office about Byrd's timing of his resignation.
Mississippi state law does not allow a convicted felon to hold public office.
U.S. District Judge William H. Steele, chief judge for the Southern District of Alabama, accepted Byrd's guilty plea Tuesday, found him guilty and set his sentencing for March 11, 2014.
