Alleghany Co. Board of Supervisor in jail for assaulting deputy & security guard

An Alleghany County Board of Supervisors member will serve ten days in jail for assaulting a Bath County Deputy and a security guard.

George Matthew Garten plead guilty to three misdemeanor charges in Bath County General District court Wednesday morning.

Garten was convicted on two assault and battery charges and one obstruction of justice charge.

The charges stem from an incident in December at the Omni Homestead Resort in Hot Springs.  This is when the assault on the Bath County deputy and a Homestead security guard. took place.

A Alleghany County Board of Supervisors representative says Garten will not be removed  from his position.

  The statute for taking a public official out of office is only for crimes involving controlled substances, hate crimes or in connection with the office.
