WEST POINT, Miss. - Authorities have charged a West Point mother with capital murder after they discovered that her 2-month-old son died from a codeine overdose.
Brittania Smith's bond hearing has been sent for July 2. Smith was indicted in April after an autopsy proved her infant son, Brinston Smith, died from a lethal dose of codeine in December at a hospital.
Sheriff Eddie Scott says the codeine allegedly used in the incident was obtained through a prescription. Scott did not say whose name was on the prescription.
Smith's lawyer said that Smith suffers form severe back pain. The attorney said Smith is scheduled for surgery on July 10. He says the county can't provide adequate medical care for her.
